Terms and Conditions of Use


INTRODUCTION
• The Hellenic Telecommunications Organisation (OTE S.A.) created the website ote.gr in order to provide online information and services to users. The use of ote.gr is governed by the present terms and conditions, which the users are asked to carefully read and conform to. The use of ote.gr entails the unreserved acceptance of the present Terms and Conditions.
• Use of websites and services of ote.gr is reserved for those who have the capacity to perform legal acts. However, OTE is not responsible in any way, in case that under aged children visit the websites of their own free will, or make use of services that may be deemed unsuitable for them.
• OTE has the right to modify the present Terms and Conditions at any time and without warning, but it is liable to update the present document with every amendment or addition.
• In the event that the use of any of ote.gr’ s services is governed by specific terms of use, these terms are considered an integral part of the present Terms and Conditions. In the event of conflict, the specific terms of use of each service apply.

CONTENT – OTE LIABILITY
• With the exception of specific third party rights (intellectual property and others), the entire content that may appear on ote.gr (indicatively: trademarks, distinctive features, photographs, text and all files in general), is the intellectual and industrial property of OTE and is protected by the relevant provisions of Greek, European and international law. This content shall not be entirely or partially traded, copied, changed, reproduced, re-transmitted or transmitted or distributed in any manner by any user.
• Third parties’ products and/or services appearing on ote.gr are the intellectual and industrial property of those third parties, who are liable for the content and services and/or products.
• Ote.gr is used ‘as is’ and users have no right to make any change or intervene in any way thereto. OTE provides for the secure use of ote.gr, as well as precise, full, valid, reliable and up-to-date information. In all cases, the users acknowledge and accept that, given the nature and size of OTE’s network, the latter may not be in the position to exercise control over the entire content and the safety of its web pages and services. For this reason, OTE will neither commit nor provide any form of guarantee, or be held liable regarding the safety and content of ote.gr. Therefore, the users accept that they must evaluate the content and that they are liable for any risk that may be caused by use of any content, including any decision of theirs to rely on the correctness, fullness, validity and/or usefulness of any content on ote.gr
• Ote.gr re-directs to third parties’ websites through links, hyperlinks or advertising banners. The providers of these websites have full civil and criminal liability for the safety, legality and validity of the content of the web pages and their services, whilst OTE bears no responsibility whatsoever respectively such as, for example, for intellectual and industrial property rights or any third party right. Therefore, users are obligated to comply with the terms of use of those websites, and contact their providers directly for any reason arising from visiting and/or using those websites.

USER OBLIGATIONS
• The users accept, agree and acknowledge that they shall lawfully and properly use ote.gr, and they are subject, among other, to the legislation on the transmission of information from Greece to Member-States of the European Union and third countries. Therefore users agree to not use ote.gr for the following purposes mentioned indicatively but not limited to as following:
• to cause damage to an under aged child.
• to transmit or gain access to content that:
1. violates any third party rights (e.g. intellectual and industrial property),  
2. offends the personality of third parties (e.g. slanderous, racist),
  3. violates the law and the principles of fair trade and good faith,
  4. violates in any manner the privacy and the personal and social rights of others.
• to mislead anyone as to the origin of the content of ote.gr, to damage in any manner the reputation of OTE or third parties, put at risk the safety of OTE’s network, to block any user from accessing ote.gr or bypassing OTE’s identification control.
• to install and promote, in any manner, any form of unsolicited or unauthorised advertising or electronic messages not requested by the user (spam), chain emails, pyramid systems and any other form of unwanted content promotion, as well as to install and promote ads without OTE’s written consent.
• to install, promote and/or provide content that contains digital viruses or any other electronic code, files or programmes designed to intervene, destroy or limit the function of any software or telecommunications equipment or block other users from using ote.gr.
• to disclose their own or third party information that contains personal information of users or third parties, either real time conversations (chats, message boards) or during the use of any ote.gr service that provides the option of communication between two or more users.
In any case of illegal or contrary to the present terms use of ote.gr, the users are obligated to reimburse OTE for any direct, indirect or consequential damage. Failure to exercise the rights stipulated in these Terms by OTE does not entail waiving those rights.

ACCESS CODES
• To access certain services or connect to certain websites, OTE may ask for personal user information with the purpose of granting a relevant Access Code. The above information must be true, accurate, valid and complete. The users are responsible for all the actions performed using the Access Code and are obligated to immediately notify OTE for any un-authorised use of same and for any (even probable) invasion of security. This information is not disclosed by OTE to third parties.
• OTE is not liable for any malfunction or damage that may arise from the unauthorized or illegal use of the Access Code by third parties, due to leak or for any other purpose and reserves the right to seek compensation by the user, in the event OTE suffers any form of damage from the unauthorized or illegal use of the Access Code. OTE has the right, at any time, to refuse to grant an Access Code or cancel a granted code or terminate the provision of services to the user and deny any current or future use of ote.gr, in the event of violation of Terms of Use.

NETWORK AVAILABILITY & SECURITY
• OTE makes reasonable efforts for the maintenance and availability of ote.gr. However, the users accept that OTE is entitled to modify and/or suspend the website temporarily or permanently, entirely or partially, with or without warning to the users. given that availability may be affected by user equipment, other communication networks, the large number of individuals attempting to use ote.gr at the same time or other causes. Therefore, OTE is not liable for any damage (direct, indirect or consequential, out of negligence, contractual or other) arising from the use of ote.gr or the inability of users to access ote.gr, the suspension of the entire or parts of the website, the delay, the lack of delivery, the interruption or bad quality provision of service or loss of its content and the existence of any type of errors. In any case, OTE reserves the right to temporarily or permanently terminate the operation of all or part of ote.gr at any time for maintenance, upgrade or any other purpose.
• Even though OTE makes every possible effort to protect ote.gr from digital viruses, it cannot guarantee that it will remain virus free. Therefore, all users must guarantee their own security (by using antivirus software, virus scanners or other protection systems) before using ote.gr or saving information, software or content of ote.gr on their computer.
• OTE is not liable for any violation of said Terms and Conditions due to force majeure. Indicatively, force majeure is considered but not limited to: earthquake, fire, flood, war.

PERSONAL INFORMATION
OTE may process any personal information which the users/visitors willingly provide through ote.gr and ote.gr services in a lawful manner according to Greek and European legislation. The website’s users/visitors acknowledge and accept the maintenance and process by OTE of an Archive containing their personal information for the purposes for which they submit it to OTE and for the promotion and the satisfaction of the market relationship. OTE may transfer the abovementioned information to linked companies or third collaborating parties for the purpose of provision of services linked to the Archive. OTE maintains the personal information by using security procedures and providing the highest possible security and confidentiality for the user’s personal information. Personal information is announced to the competent judicial, police and other administrative authorities following lawful application and according to the applicable legislative provisions each time.

Users reserve the rights of articles 11 to 13 of Law 2472/1997.
The users/visitors are liable for submitting third parties’ personal information to OTE without relevant authorisation, as well as submitting false, fake or inaccurate data and information for the purpose of deceiving or misleading OTE.
OTE is not liable against the users for any leak of personal information due to their use, through ote.gr, in third party products and services.
Answers to votes that may be carried out on ote.gr are recorded, analysed and commented on by OTE, who reserves the exclusive right to use that information, the conclusions of which are OTE’s intellectual property.

COOKIES
OTE may use cookies to identify a user. Cookies are small text files that are saved on the user’s hard drive, and do not read any document or file on the user’s computer and are solely used to simplify user access to specific services and for statistical purposes, in order to determine the regions in which ote.gr services are useful or popular or for marketing purposes. The user can configure his/her server not to receive cookies, either entirely or per case. In this case the user will not have further access to these services.

APPLICABLE LAW – JURISDICTION
The present Terms and Conditions of Use and any modification thereto are governed by the Greek Law and sole jurisdiction is granted to the Courts of Athens.
